Sounds like you already know the answer. This guy has a track record of buying land, cramming stuff onto it and moving on, using the legal system as a fallback for getting his way. This particular community is one that didn't flinch, so (surprise!) he's suing. He'll lose. He'll get over it.
I'm among the minority of planners in the state who'll give the free market a ton of leeway, but I get concerned when a development comes up that's clearly driven solely by money. I think there are actually two groups of developers, and the more professional ones understand the nature, art and process. Then you have your weekend-warrior equivalent, fed by infomercials and Gone with the Wind: They beleive in the "highest and best use" ideaology, and anything else is a violation. The problem, of course, is that land is different from commodities in most every sense. Further, EVERY property is co-dependent on it's surroundings and built structures are not easily changed once people realize their shortcomings. A little thoughtfulness and attention goes a long way.
Sorry, clearly my mind is honed for debate.

Yeah, I guess what irks me about these characters is that they feel they have a right to profit at public expense..and do so openly (i.e. they're not like arms dealers or drug dealers who operate in the shadows). And that they attract a gaggle of media and property rights groups that start throwing around, well, lies about the facts of the case. And that small communities that try to stand up for the public interest have to spend the public's dollars defending that interest (i.e. lawyers fees).
Apologies to our friends on the thread if this is getting too political!! :)

So, does Georgia have a statute, or case law, that would give the plaintiff a case? If he's asking for a rezoning, and he had no legal commitment from the regulatory body (the county?) when he bought it, how can denying him "reasonable" use of the property constitute a taking? I thought the Sup. Ct. had made it clear that something less than complete maximum profit was an acceptable level of use and therefore did not justify a takings claim? Can't he just develop it as allowed under current zoning regulations and make a reasonable profit?
Developers...don't get me started.... :mad:

When Mother Nature makes a taking...where can you go for recompense?
I guess to FEMA for a flood insurance claim?
Of course, SC's regs were there to protect beaches, in part because they absorb storm surges, which Lucas fought, and won in the Supreme Court.....but then lost to Hugo...and then won through an insurance claim...which the public paid for...so, WE lose. [See post above] :(
