What exactly IS the LLC?

    What exactly IS the LLC? Formed to cover the tailgates, and that is it.

    Mark, where do you see the need as it pertains to tickets I would buy for people going on road trips? I'm open to your thoughts, but I just don't see the need.

    Either by suing about posted information for slander, libel, or restraint of trade (if the site broke news of the sale of naming rights to the new stadium and such a disclosure caused the deal to fail).

    The other issue I can see is if peoples' picture were posted without their knowledge and there was an invasion of privacy issue that came to a lawsuit.

    Think drunken tailgating pictures that then cause someone to lose a job or a promotion.

    Not saying any of us would sue for those reasons, but as I have been reminded, you can sue anyone for anything ... there's just no guarantee you're going to win.

    Okay, as a non-LLC member I just have to ask....

    Who gives a crap?? Why is this an issue? If a few of the people who have been responsible for handling the tailgate want to create an LLC to cover their butts from potential any legal backlash, why do we care? It's not costing any of us anything; it doesn't really impact any of us. I just don't get why this has become such a huge issue.

    As to why they need it....you're kidding, right? In today highly litigious environment you don't think someone might get sick (or even die) as a result of one of our "activities and either they or their family wouldn't look for anyone remotely connected to the situation to attach to the lawsuit.....please! I'm not involved with the LLC or directly with it's members activities, but if I were I can tell you that I've worked too hard building what little I do have to let some jackass take it away because they chose to eat/drink with us.

    Hey, if you're attaching drunken tailgate photos to your resume, you deserve to not get the job. ;) But seriously I know what you mean. I"ve seldom specifically asked for someone's permission to post their pics (the People page being the exception to this) but I would definitely remove pics if asked to.

    I understand you are willing to trust people are going to pay you and that you are going to front the costs.

    But, 2 years or 10 years from now, will you still be the one organizing road trips. No, probably not.

    So, by having an LLC front the costs, there is no personal outlay and the ticket buyer is protected. If a bus is arranged for 30 Wizards fans to ride in and it crashes .... etc, etc.

    I hear ya. If the format changed, where the group was providing transport, I see the need.

    And Robert, I hear you as well. For the food, which is probably our only concern right now, it is a good idea.

    My biggest concern right now is what we do with the profits. We're making money and we need a plan to use it.

    And this is where the need to become more formally organized comes into play. The only way to properly ensure that the monies collected are used appropriately (not a dig at anyone in the LLC as I trust most of you completely) is to create the formal Supporter Group. Then, and I know this sucks, we would have to get financial reports from the LLC on a regular basis (monthly/quarterly/annually) that details the monies coming in and going out as well as what the plans are for any profits that are realized.

    I know this makes it sound like a business, but I guess that's kind of what it is.

    See, I knew that MBA would materialize some day.

    1st not trolling, that offended me, OK not really but come on. really just curious.

    People can't sue over a web site unless Stu himself goes out and slanders someone directly. Pic of people in public are fair game. I know someone who lost a job absed on some things that were on her MySpace page, she had no legal recourse though she tired.

    I almost see the need for a LLC because there are dues and money involved. I can also where this is a good thing once the group becomes very large (500+) Beyond that I have to agree with most who are volunteering and doing thing based on being a good guy/gal. There some inherent risk with being a good human, people are fickle at time adn care more about themselves that doing whats right.

    either way sounds like it a done deal so good luck with it.

    Yeah, well.... We don't have a sewage-infested river running behind our stadium... :D

    I am pretty sure that at some point, the Screaming Eagles were an LLC, but now I see that they've actually gone full-bore and incorporated.

    Actually, the Blue River in the East Bottoms is closer and would work far better. The body would dissolve on contact.
