    Going topless is not "speech"; burning a religious book is "speech".

    While the latter in more offensive, it is protected by the First Amendment while the former is not. See the cases holding that burning the American flag is protected "speech". I can see an argument that going topless is indeed "speech" and perhaps one day a court will hold that it is.

    While the book burning was legal, that doesn't mean it's "right" or condoned by the government. It just means the government cannot prevent it. I think the minister does bear some responsiblity for the resulting deaths, but it's a level of responsibility that falls short of criminal or civil responsibility.

    wouldn't it depend on the intent of what you're wanting to accomplish by burning a book or going topless to determine if it's speech or not?

    for instance, I never quite got why the women's movement never got on board with the whole topless thing as part of women's equality. other than the shape of the female breast, it's essentially the same as a male's. the censored part especially (the nipple), is pretty much exactly like a male's. so why is it okay for a male to go topless, but not for a female? why I've seen some fat dudes at the beach that have way more cleavage and some serious man cans, yet it's okay for them to go topless? so if a woman went topless to protest this abhorrent inequality, wouldn't that be free speech?

    I agree, that's why I think topless could be speech - a protest agaisnt our patriarchal culture/society. This isn't my area of the law though.

    I'd support a law requiring men to keep a shirt on - there are some disgusting sights out there.

    And so are the cultural hatreds, middle America reserves its ire for our Spanish-speaking brown people. I'm sure if we had an Islamic presence like Europe does you'd hear plenty of people calling for the same kind of ban.
