http://globoesporte.globo.com/futeb...btem-liminar-na-justica-comum-contra-cbf.html Does this have any real implications? Or is it a useless judgement that will result in counters and more legal hold-up? I always get frustrated reading globo articles because it never goes into what the real implications are. It's like they hold back on key parts just to get more views.
Mengao you closed down the Brasileirao thread and now this is happening! http://globoesporte.globo.com/futeb...btem-liminar-na-justica-comum-contra-cbf.html and the reaction http://globoesporte.globo.com/futeb...com-flu-eles-tem-que-acertar-com-o-porto.html
But.. the decision will only be posted and validated on Monday... so CBF can't even argue against the decision and Fluminense until monday is still in the first division. On monday they will no longer be in the first division... Much like CBFs posting of the decision was only on monday after the games hahahaha. The judge argued exactly that, since CBF and STJD only posted the decision on monday it can't count for a previous date, which makes sense.
It´s a judgement correctly interpreting a federal law, which has precedence over the imbecile STJD and it´s stupid rules that "criam dificuldades pra vender facilidades".
Portuguesa mess more chaos for Brazilian football Posted by Tim Vickery http://espnfc.com/blog/_/name/futebolbrasil/id/949?cc=5901
It's frustrating to realize that Flu will turn the table no matter what. Either Portuguesa doesnt get the 4 points back and Flu jumps over them, or Portuguesa wins on the field and the courts to claim the 4 deserved points, only to have the CBF increase the amount of teams in the brasileirao. Fluminense, tapetao eterno
actually, CBF can´t increase the number of teams next year without the risk of even more lawsuits. BECAUSE the Estatuto do Torcedor (Federal Law) which works like a consumer´s protection law, establishes that the rules of the competition can´t be changed just like that. The rules of the competition must be changed at least six months prior to the competition. So, if CBF changes the rules, the Brasileirão would have to start only in July.
Since the 2013 Brasileirao thread is now locked and there's no 2014 thread yet.. I guess I'll post the following information here: ESPN Brasil showed docs indicating that Brazil FA offered Portuguesa R$ 4 million to convince them to play Série B & take no legal action. In theory Portuguesa would have to give back these 4m in 2015, but the $ would help them return to Série A. They are likely to reject the offer.
There's a thread open specifically for the dispute: https://www.bigsoccer.com/community/...nd-39-stjd-v-portuguesa-and-flamengo.1999225/ Nice scoop by ESPN Brasil if real.
Ronaldo cogita assumir a CBF e diz que Portuguesa foi incompetente - http://t.co/JxxY8aBv2R— Lance! (@lancenet) January 20, 2014
My initial reaction to this was.. Ronaldo is a dumbass.. after actually reading what he said..I agree with him. He didn't call Portuguesa incompetent, he actually said brazilian football is filled with incompetent people, and Portuguesa's president should be firing his judicial advisors for their incompetence. Which I do agree, you mess up you should get fired. Now.. the other side of this argument to me is, that doesn't change the fact that CBF posted the decision after the game was played, making it valid only after the game.
@Guigs: it also doesn´t change the fact the CBF rules + STJD are the typical brazilian system of "create difficulties to sell easy ways" (criar dificuldades pra vender facilidades). In this case, the system was created to ALLOW suspended players to play, just so the STJD can be justified in its stupid existence AND make controversial rulings to ease a club´s path, make it difficult for another, and so on.
MP finds suspects of facilitating Everton being listed for the game even knowing that CBF would make Lusa lose 4 points. They believe there was an exchange of money to favor Flu.
