It is based over the previous 3 seasons I believe. And *rey* will have to correct me but wasn't it America years back that was relegated but they bought a promoted team to stay in the top flight? Part of the reason FIFA made the rule change about pro/rel. Go Pachuca!
Chivas will never be relegated! Chalk it up to "to big to fail" as La Liga MX pro/reg is farcical. In a sense the way the Mexican fed feels about pro/rel props up the way MLS and other US leagues are currently structured. Operating under the theory that big tv markets/teams have to stay up (Mexico City, Guadalajara, Monterrey) but smaller markets/poorer teams are pushed down (Celaya, Aguascalientes, Tampico). I wish La Liga MX would make up its mind and have true pro/rel with 20 teams with 3 going up and 3 going down or go NBA with 20 permanent team's and 20 developmental teams in smaller markets. FTR - it's the last 3 full football seasons (or 6 short tournaments) points per game that determines who goes down: Pts earned/# of games. For teams that have been in the top division for all years it works out to be 102 games (17 games per short season times 6).
